We care about its future.&nbsp;<\/p>\n\n\n\n<p class=\"has-18-font-size\">Courts frequently decide on legal questions, and interpret statutes and regulations that affect the functioning of the Internet. Often, courts confront questions about how to apply laws to rapidly changing Internet technology. The Internet Society Amicus Program is how we share our views with the courts to ensure that any laws that are passed support the open, globally connected, secure, and trustworthy Internet.<\/p>\n\n\n\n<p class=\"has-18-font-size\">Through the Amicus Program, the Internet Society shares its technical and policymaking expertise to help courts understand how their legal decisions will impact the Internet, including how decisions will promote or hinder openness, connectivity, and security on the Internet. Through our amicus efforts, the Internet Society brings a credible voice to cases critical to the functioning of the Internet.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-green-color has-text-color has-32-font-size\">How Do We Influence Internet Law?<\/h3>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"has-18-font-size\">An amicus brief is a written submission to a court in which a person or organization who is not party to the proceedings can present relevant information and arguments to assist the court in deciding on the question presented in the case.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-green-color has-text-color has-32-font-size\">Where Do We Appear as Amicus?<\/h3>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"has-18-font-size\">Because amici curiae play a critical role in litigation in the United States and are expressly permitted by court rules, to date the Internet Society has filed amicus briefs in U.S. courts. Sony Music Entertainment before the U.S. Supreme Court<\/a>. In our brief, we argue that holding Internet service providers liable for users\u2019 alleged copyright infringement would threaten privacy, endanger small ISPs and community networks, and risk disconnecting entire communities from the Internet.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-8658c666\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 23 September 2024, the Internet Society <a href=\"https:\/\/www.internetsociety.org\/blog\/2024\/09\/texas-mandatory-age-verification-law-will-weaken-privacy-and-security-on-the-internet\/\">joined an amicus brief led by the Center for Democracy and Technology (CDT) in the Free Speech Coalition v Paxton case before the US Supreme Court<\/a>. We explain the challenges of current age verification technologies and discuss how upholding Texas\u2019 law requiring age verification will actually weaken the privacy and security of users.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-3b069bbc\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 6 May 2024, the Internet Society <a href=\"https:\/\/www.internetsociety.org\/wp-content\/uploads\/2024\/05\/Amicus-Brief-TikTok-v.-Knudsen_05.06.24.pdf\">filed an amicus brief in the \u201cAlario and TikTok v Knudsen\u201d case before the US 9th Circuit Court of Appeals<\/a> related to Montana\u2019s law SB 419 banning TikTok. We offered our view that if the law is allowed to take effect, it may lead to a fragmented Internet experience within the US, as more states may start to ban apps. We also explained why the ban will not work technically. <a href=\"https:\/\/www.internetsociety.org\/blog\/2024\/05\/montanas-tiktok-ban-breaking-the-internet-and-undermining-online-privacy\/\">Read an overview<\/a>.<\/p>\n<\/div>\n<\/div><\/section>\n\n\n\n<section class=\"wp-block-uagb-columns uagb-columns__wrap uagb-columns__background-none uagb-columns__stack-tablet uagb-columns__valign- uagb-columns__gap-10 align uagb-block-ad56e15f uagb-columns__columns-3 uagb-columns__max_width-theme\"><div class=\"uagb-columns__overlay\"><\/div><div class=\"uagb-columns__inner-wrap uagb-columns__columns-3\">\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-7a76ba25\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 3 April 2024, the Internet Society <a href=\"https:\/\/www.internetsociety.org\/blog\/2024\/04\/protection-for-intermediaries-is-vital-for-the-internet-in-mexico\/\">filed an amicus brief in the Richter v Google case before the Supreme Court of Mexico<\/a> (formally, Amparo Directo number 8\/2023, under prosecution before the First Chamber of the Supreme Court). We offered our perspective on the importance for the Internet of upholding protections for intermediaries from liability for user-generated content, including protection for their content moderation decisions.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-dac5a527\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 11 March 2024, the Internet Society <a href=\"https:\/\/www.internetsociety.org\/blog\/2024\/03\/nevada-wants-to-reduce-online-protections-for-children\/\">joined with seven other organizations to file an amicus brief in the Nevada v. Meta case before the District Court of Clark County, Nevada<\/a>. We argue that the court should deny Nevada&#8217;s motion for a preliminary injunction to block end-to-end encryption from being the default in Facebook Messenger.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-019d9445\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 7 December 2023, the Internet Society <a href=\"https:\/\/www.internetsociety.org\/blog\/2023\/12\/can-you-kick-the-trolls-out-of-your-online-forum-u-s-supreme-court-to-decide\/\">filed an amicus brief in the U.S. Supreme Court in the combined cases of Moody v. NetChoice and NetChoice v. Paxton<\/a>. We argue that the ability to moderate content in an online discussion is critical to building strong online communities, and provides a better user experience, enables safe discussions, removes harmful posts, and prevents threats.<\/p>\n<\/div>\n<\/div><\/section>\n\n\n\n<section class=\"wp-block-uagb-columns uagb-columns__wrap uagb-columns__background-none uagb-columns__stack-tablet uagb-columns__valign- uagb-columns__gap-10 align uagb-block-3c4f5609 uagb-columns__columns-3 uagb-columns__max_width-theme\"><div class=\"uagb-columns__overlay\"><\/div><div class=\"uagb-columns__inner-wrap uagb-columns__columns-3\">\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-3591c3c9\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 19 January 2023, the Internet Society&nbsp;<a href=\"https:\/\/www.internetsociety.org\/wp-content\/uploads\/2023\/01\/Internet-Society-Gonzalez-v-Google-Amicus-Brief.pdf\">filed an amicus brief in the U.S. Supreme Court in the Gonzalez v. Google<\/a>&nbsp;case. We argue that liability protections\u2014as contained in \u201cSection 230\u201d in U.S. law\u2014are essential for many different types of service providers on the Internet to continue to carry and support the vast array of commentary, artistic works, and other content posted by individuals all around the world.&nbsp;<a href=\"https:\/\/www.internetsociety.org\/wp-content\/uploads\/2023\/01\/Quick-Overview-of-Amicus-Brief-Gonzalez-v-Google.pdf\">Read an overview.<\/a><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-cc30cb1f\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 11 October 2022, the Internet Society&nbsp;<a href=\"https:\/\/www.internetsociety.org\/wp-content\/uploads\/2022\/10\/Hunley_v._Instagram-Amicus_Brief_of_Internet_Society.pdf\">filed an amicus brief in the U.S. Court of Appeals for the Ninth Circuit in&nbsp;<em>Hunley v. Instagram<\/em><\/a>. In our brief, we argue that the act of embedding content or code is critical to the Internet\u2019s generative and modular capacity, without which the Internet and Web would be a mere shadow of what they are today.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-column uagb-column__wrap uagb-column__background-color uagb-block-7dba31a1\"><div class=\"uagb-column__overlay\"><\/div>\n<p class=\"has-18-font-size\">On 4 December 2020, the Internet Society, the Electronic Frontier Foundation, and the Center for Democracy &amp; Technology<a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2020\/12\/2020-12-04-WeChat-EFF-CDT-Internet-Society-amicus-stamped.pdf\">&nbsp;filed a brief of amici curiae in the United States Ninth Circuit Court of Appeals<\/a>&nbsp;in the U.S. WeChat Users Alliance case.
